Yesterday, the Hagerstown Police Department reported that on Christmas Day 2021 around 6:30 p.m., their Officers responded to 320 S. Burhans Boulevard in response to a call concerning a reported gunshot victim. The female victim, later identified as Tristen Shifflet, age 37 of Hagerstown, was transported to Meritus Medical Center where she succumbed to her wounds.
Through their investigation, police learned that Shifflet’s boyfriend, Justin Kyle Marshall, age 34 of Greencastle, Pennsylvania, shot her with a handgun during a dispute, striking her in the neck. Marshall fled the scene prior to the arrival of officers. Further investigation revealed that he had fled to Berkeley County, West Virginia.
Authorities with the Berkeley County Sheriff’s Department caught up with Marshall and took him into custody at approximately 2:45 a.m. on December 26.

Police said that in addition to shooting and killing his girlfriend in Hagerstown, Marshall had an active arrest warrant through the Pennsylvania State Police for assault in a separate incident involving Shifflet.
In November, a warrant was issued for Marshall in Franklin County on charges of aggravated assault, strangulation, simple assault and child endangerment, according to online court dockets shared by Pennlive.
And Marshall was no stranger to law enforcement. In 2004, he had been convicted of 2nd degree murder in a non-domestic related Hagerstown homicide. He was released from prison approximately two years ago.
In 2004, Marshall was one of two people convicted in the killing of 46-year-old Curtis Hill Sr., who was beaten to death during a robbery, according to AP reports.
Marshall and Shifflet shared a young child together. Washington County Child Protective Services took custody of their little boy and made further arrangements for his housing.
Marshall has been charged with 1st Degree Murder and numerous other related charges regarding the Christmas Day shooting of his girlfriend. For more on the story, see the video accompanying this article.
