(Updated November 21, 2018)  Yesterday, The Daily Herald reported that Brian Varela “pleaded guilty to second-degree manslaughter, third-degree rape, and unlawful disposal of remains as part of a plea deal in the February death of 18-year-old Alyssa Noceda.”

As part of that plea deal, Varela was only sentenced to two years and 10 months behind bars for his cold and callous actions.  Not only was the victim’s family outraged, but the judge overseeing Varela’s sentencing was also apologetic for the light sentence.

Superior Court Judge Linda Krese said she could not sentence Varela to more than two years and 10 months behind bars because it was the most prison time permitted for someone with no prior criminal record.

(Original article from February 24, 2018)  Brian Roberto Varela, the 19-year-old man from Lynnwood, Washington, who reportedly raped 18-year-old Alyssa Mae Noceda in early February as she lay dying from a drug overdose, was charged in a Snohomish County Superior courtroom yesterday with the girl’s first-degree manslaughter and second-degree rape. In the unimaginable and horrendous case against Varela, court documents described him joking, bragging and texting pictures of Noceda as she died to three of his Dairy Queen co-workers.  The images showed Noceda passed out and bluing, according to The Herald Net.

Varela told his co-workers and later confessed to investigators that Noceda snorted some crushed Percocet pills and that he also gave her some potent THC that fateful night of February 3.  Only about one minute after ingesting the drugs, the girl collapsed on Varela’s bed.

Instead of dialing 9-1-1, Varela took a picture of the girl in her underwear and forwarded the image to his friends. People shared a text message that Varela reportedly sent to his friends:

“LOL I think she OD’d, still breathing, I’m smashing her to pass the time,” Varela then allegedly wrote to the group.

He allegedly noted that, in the photos, Nocedato  [Noceda] was “on her back with swollen purple/blue lips” and “clearly unconscious.”

“But not joking she od bruh,” he reportedly wrote in a text at 11:36 p.m. He added that he could continue to sexually assault her …

CBS New reports Varela as saying that he was too tired to drive the girl to the Emergency Room, so he just went to sleep.  He awoke the next morning to find that Noceda was dead.

Varela showed the girl’s lifeless body to his roommate and another friend and said that he had called 9-1-1; but he really had not.  He left the dead girl in his locked bedroom and went to work a double-shift at Dairy Queen. According to The Herald, when he returned home:

That night around 11 p.m., Varela grabbed a plastic crate from his mother’s home down the street, returned to the room and washed the body in an effort to destroy DNA, the charges say. He took a last picture of Noceda’s body at 2:58 a.m. Feb. 5. Then, he told police, he stuffed the body in the crate, tossed a sheet over it and went to bed.

Varela later confessed to police that he was able to unlock and access Noceda’s cell phone by using the dead girl’s thumb print.  He then got into her SnapChat account, and posing as Noceda, posted that she was running away. Court documents also stipulate that Varela had washed the dead girl’s body in an attempt to to clean away his DNA.

One of Varela’s Dairy Queen co-workers informed police that there was a dead body in Varela’s bedroom.

Officers arrested Varela at his home with Noceda’s body still stuffed in a crate.  He has been held on $500,000 bond. His arraignment is scheduled for February 26.

Noceda’s family members have established a GoFundMe account to help cover funeral expenses.
